PLEASE READ BEFORE PROCEEDING TO USE THIS WEBSITE

1) Shetland to shire has made every effort to ensure that the information contained within its site (where placed directly by Shetland to Shire) is accurate and as such, takes no responsibility whatsoever for any errors and/or omissions, or for any consequences arising to any person due to reliance’s made on the Shetland to Shire website (hereafter referred to as the site).

2) Shetland to Shire places adverts on its site directly from third party advertisers and as such, cannot offer any form of warranty and makes no representation whatsoever as to the legality and accuracy if all contents, photographs and suitability of any advertisement, or other material contained within the site.

3) Shetland to Shire has no way of totally verifying the identity of people who use the site and therefore we recommend that customers use common sense, proceed with caution and make suitable enquiries when dealing with third party advertisers who advertise on the site. Please be aware that there are a number of scams in operation involving horses (and other items such as cars and motorbikes), for more advice on this, please see our SCAM ADVICE section found on the homepage.

4) When purchasing animals Shetland to Shire would advise you to seek advice from a suitably qualified professional such as a veterinary surgeon (we would always recommend that you get any animal vetted before agreeing to a purchase), riding instructor or trainer.

5) Shetland to Shire cannot accept any liability for any type of loss, or for any other consequences whatsoever arising to persons as a result of usage and reliance of any contents or other material contained within the site. Therefore, any person using this site agrees to release Shetland to Shire from all matters and claims that may arise between parties who use the site, to include losses in any form e.g. monetary, personal, business, damages, injury or any other occurrence that can be linked with any form of claim or action.

6) It is the advertiser’s responsibility to ensure that they are legally allowed to sell/advertise an animal/item, or indeed advertise generally when placing an advert. The advertiser is solely responsible for the accuracy and legality of all contents (including website links, logos etc.) and photographs contained within any advert they place and they agree to pay the relevant fee for advertising (if applicable to the category advertised in).

7) When using photographs in an advert, you must seek permission from the copyright holder before using an image and should include photo credits in the advert description (if applicable). Shetland to Shire cannot be held responsible for any issues arising with the copyright of photographs or any other contents/information placed and contained on the site.

8) Shetland to Shire reserves the right to refuse/amend any advert (without justification), especially if an advert placed breaches the Shetland to Shire Terms & Conditions as outlined herein.

9) Shetland to Shire will not offer refunds under any circumstances. It is the advertiser’s responsibility to ensure that they have placed their advert correctly by following the Terms & Conditions of advertising and by paying the correct fee (if applicable). If you require clarification of the Terms & Conditions or other information contained on the site, we would advise you to contact us before placing an advertisement.

10) Shetland to Shire offers no guarantees that any animal or item advertised on the site will sell, or that you will find an animal/item that you are hoping to purchase, or that the site will increase your customers if advertising a product or service.

11) Adverts must not contain anything that could be considered offensive in any way to another person e.g. foul/abusive language, threatening or slanderous comments, improper references etc. Any person found to try and place an advert containing such material (or indeed including links to any websites that may contain such material), will be banned from using the site. Anyone found to be placing adverts on behalf of a banned person will also be banned, as will anyone found to be using the site in an improper or fraudulent manner. Relevant authorities may be informed of anyone found to be misusing the site in any improper manner.

12) Adverts must not contain any reference or web links to any other websites that could be classed as a rival to Shetland to Shire (e.g. offering third party advertising with a similar theme/contents to that of the Shetland to Shire site). Web links will only be accepted at Shetland to Shires discretion. All web links will be checked to ensure they comply with the Terms & Conditions of advertising and will be removed without warning if considered to be a breach of the Terms & Conditions of advertising on the site.

13) Advertisers can edit any advert they place at any time throughout the advertising period paid for (if payment is applicable, advertisements remain on the site for a maximum of 12 months, after which they will automatically be removed), however, substitute animals/items will not be allowed to be placed on the same advert. Any advert found to be containing a substitute animal/item from that of the original advert will automatically be removed without notification and before the advertising period has expired.

14) When contacting an advertiser via our hidden email services on site, all emails are copied to Shetland to Shire. Any emails found to be containing anything offensive, references to other websites, anything “improper” or considered to be spam will be filtered out and rejected. However, we cannot guarantee that an improper email will not get a customers inbox. We would ask that anyone who receives anything via their inbox that could be considered as spam to inform us as soon as possible so that we may take the appropriate action.

15) Shetland to Shire will not pass the details of any person who registers to use its site onto any third parties (unless required to do so by British Law e.g. if someone has been using the site in a fraudulent manner). However, we cannot guarantee the safety of personal details held on the site due to circumstances beyond our control. You are advised not to disclose your user name and password to any other person for your own security. We will only use your details to contact you regarding any advertisement placed and occasionally about any changes to the site (unless you have requested that we do not contact you regarding changes to the site etc).

16) Our payments are powered via the Paypal Secure Servers and although they will clarify the details of any person making a payment to Shetland to Shire, they will not pass any financial details to Shetland to Shire and therefore the site will not hold any financial details of any person using the site to place advertising. 17) Anyone under the age of 18 must have the permission of a parent or guardian before placing an advert on the site.

18) Due to circumstances beyond the control of Shetland to Shire, the site may sometimes not be live “live” on the internet e.g. server down times etc. We cannot be held responsible for any consequences that may arise as a result of circumstances beyond our control. However, Shetland to Shire will leave adverts on for longer advertising periods at their discretion should exceptional circumstances happen. If Shetland to Shire has to take down the site from the internet for reasons such as upgrades etc. (which we will try to keep to a minimum), we will automatically leave adverts on for the time the site was not live on the internet.

19) Shetland to Shire will take legal action against any person found to be directly accessing or abusing the site in any way whatsoever (e.g. causing the sites usage to be impaired, damaging the good reputation of the site, causing us to lose the services of our suppliers or advertisers and any other kind of action that may cause the Shetland to Shire Site problems of any kind. In using this site you agree not to download or copy any part of this site. You also agree not to link to the site in any way whatsoever without the permission of Shetland to Shire in writing.
